Provider Agreement

Back to Legal

Last updated: July 2026 (brokerage support). Adds Brokerage Mode and U.S. Coast Guard Compliance sections. Pending final counsel review before publication.

Eligibility

To list a vessel on VesselParty as a direct provider, you must be the legal owner or authorized operator. To list a vessel as a brokerage, you must have a written agreement with the vessel owner authorizing you to represent it on the platform. In both cases, you must hold all required licenses and permits, maintain valid marine insurance, and pass our verification process.

Listing Requirements

Listings must include accurate descriptions, current photos, transparent pricing, and up-to-date availability. You must respond to booking requests within 24 hours.

Commission Structure

VesselParty retains a commission on each completed booking. The default rate is 15%, and the rate applicable to your account may differ if agreed in your Provider Agreement (for example, brokerage accounts may negotiate a different rate). The rate in effect at the time of booking applies to that booking. Commissions cover platform services, marketing, payment processing, and customer support.

Insurance & Liability

Vessel owners must maintain comprehensive marine insurance covering passengers and third-party liability. VesselParty provides supplemental coverage but does not replace your primary insurance.

Termination

Either party may terminate this agreement with 30 days written notice. VesselParty reserves the right to immediately suspend listings that violate safety standards or community rules.

Brokerage Mode

Providers may enable brokerage mode to list vessels owned by third parties. Before your first brokered listing goes live, you must confirm that (a) you hold a written brokerage or agency agreement with each vessel owner whose vessel you list on VesselParty; (b) all listed vessels comply with U.S. Coast Guard chartering rules, including captain licensing (OUPV, Master) and Certificate of Inspection where required; and (c) you carry agent/broker professional liability insurance separate from the vessel's hull insurance, covering your brokerage activity on VesselParty. You indemnify VesselParty against any claim by a vessel owner, captain, or third party arising from listings you place under brokerage mode. VesselParty may terminate brokerage privileges for false attestations, U.S. Coast Guard non-compliance, or lapse of required insurance.

U.S. Coast Guard Compliance

You represent and warrant that (a) any captain operating a vessel you list holds a current, valid U.S. Coast Guard license appropriate for the size of vessel and number of passengers — typically an OUPV license for six or fewer paying passengers, or a Master license with an inspected vessel Certificate of Inspection for larger groups; (b) each vessel is documented or registered as required by federal and state law; and (c) each vessel carries commercial marine insurance in force during the booking. You will provide copies of these documents upon VesselParty's request. Failure to maintain U.S. Coast Guard compliance or to produce documentation on request is grounds for immediate suspension of your listings.
