VesselParty Terms of Service
Version 1.3 – Effective January 27, 2026
1. Introduction
This Terms of Service Agreement ("Terms") is a legal contract between you ("User", "you") and VesselParty, Inc. ("VesselParty", "we", "our"), a Delaware corporation. By accessing or using the VesselParty website, mobile application, or services (collectively, the "Platform"), you agree to be bound by these Terms. If you do not agree, do not use the Platform.
2. Definitions
- "Platform": Website, mobile application, and other digital services operated by VesselParty.
- "User": Any individual using the Platform to book or browse Listings.
- "Provider": A third-party vessel owner or operator offering Listings on the Platform.
- "Listing": A vessel-based experience or service offered by a Provider.
- "Booking": A confirmed reservation for a Listing.
- "Services": All services provided through the Platform, including booking, payment processing, customer support, and content publication.
3. Eligibility
You must be at least 18 years of age and legally capable of entering into contracts. You may not use the Platform if your account has been suspended or terminated by VesselParty.
4. Account Registration
To access certain features, you must create an account. You agree to provide accurate information and to update it as needed. You are responsible for maintaining the confidentiality of your account credentials.
5. Nature of the Platform
VesselParty provides an online marketplace for Providers to offer vessel experiences to Users. VesselParty does not own, operate, or control the vessels or services offered by Providers. We are not a transportation carrier, boat operator, or maritime service provider.
6. User Responsibilities
Users must comply with all applicable laws, behave respectfully, and follow Provider instructions. Users are solely responsible for their conduct and the conduct of any guests accompanying them.
7. Provider Responsibilities
Providers are fully responsible for their vessels, operations, legal compliance, safety, insurance, and crew. Providers must ensure accurate Listings and maintain required licenses and permits. VesselParty does not verify the qualifications or compliance of Providers.
8. Listings
Providers may create Listings through the Platform, which must be complete, truthful, and compliant with local regulations. VesselParty reserves the right to remove any Listing that violates our standards or applicable law.
9. Bookings, Payments, and Fees
When a Booking is made, VesselParty charges the User and collects payment on behalf of the Provider. A service fee may apply. Payments are processed through third-party services and subject to our Payment Policy. Payments may include taxes, fees, and other applicable charges. You authorize VesselParty to collect payment, including any security deposits or fees resulting from damage claims. You authorize VesselParty to make pre-authorizations or additional charges in accordance with our Damage Policy.
10. Security Deposits and Damage
Providers may require a security deposit. If damage is reported, the User authorizes VesselParty to deduct from the deposit. Disputes will be resolved under our Damage Policy. Please refer to our Damage Policy for more details.
11. Cancellations and Refunds
Cancellations are governed by our Cancellation Policy. VesselParty reserves the right to override cancellation terms in cases of force majeure or safety risks.
12. Insurance
VesselParty does not provide insurance for Users or Providers. Providers are required to carry appropriate commercial maritime insurance. VesselParty does not verify or guarantee the existence, validity, or scope of any insurance policy offered by Providers. Users are encouraged to obtain personal travel or liability coverage where appropriate.
13. Content and Intellectual Property
Users and Providers grant VesselParty a non-exclusive, worldwide, royalty-free license to use, display, and distribute any content uploaded to the Platform. All content on the Platform is protected by copyright and trademark laws and belongs to VesselParty or its licensors.
14. Prohibited Activities
Users may not: use the Platform for illegal purposes, misrepresent identity, post misleading content, interfere with others' use of the Platform, or circumvent payment systems.
15. Termination and Suspension
We may suspend or terminate your account for violations of these Terms, law, or risks to safety. Users may terminate their account at any time via the Platform.
16. Limitation of Liability
To the fullest extent permitted by law, VesselParty shall not be liable for indirect, incidental, or consequential damages. Total liability shall not exceed the amount paid for the Booking in dispute.
17. Indemnification
You agree to indemnify and hold harmless VesselParty and its affiliates from any claims, losses, or damages arising out of your use of the Platform or breach of these Terms.
18. Dispute Resolution and Arbitration
All disputes will be resolved by binding arbitration in the State of Delaware under the rules of the American Arbitration Association. No class actions or jury trials are permitted. You expressly waive any right to participate in a class action against VesselParty.
19. Governing Law
These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles.
20. Updates and Modifications
We may modify these Terms at any time. Continued use of the Platform after changes are posted constitutes your acceptance of the updated Terms.
21. Electronic Communications
You consent to receive communications electronically. These may include notices about your account, legal updates, or marketing. You can opt-out of marketing emails at any time.

23. Governing Language
In case of conflict between the English version and any translation, the English version of these Terms of Service shall prevail.
